1. Introduction

These Terms and Conditions (the “Terms”) are entered into between you and THURSDAYTHINKING.DIGITAL LTD, trading as ThursdayThinking.Digital (“we”, “us”, “our”, the “Company”). They govern your access to and use of thursdaythinking.digital (the “Website”), including all content, features and functionality made available on or through it.

Please read these Terms carefully before using the Website. By using the Website, you accept and agree to be bound by them and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Website.

2. Scope: Website Terms vs. Our Client Agreements

These Terms cover use of the Website only. They are not the contract that governs any services we provide.

If you’re an existing or prospective client engaged for our marketing services, that relationship is governed by a separate service agreement between you and ThursdayThinking.Digital, not by these Terms.

You can view or download our current client service terms here: Client Service Terms (PDF)

If anything in these two documents conflicts in relation to a services engagement, the client service terms take precedence.

3. Your Acceptance of These Terms

By accessing and using the Website, you confirm that you accept these Terms, that you are of legal age to form a binding agreement, and that if you access the Website from a jurisdiction where doing so is not permitted, you do so at your own risk.

4. Updates to These Terms

We may revise these Terms from time to time at our discretion. Changes take effect as soon as they’re posted here. Continuing to use the Website after an update means you accept the revised Terms, so it’s worth checking this page occasionally.

5. Your Responsibilities

You’re responsible for ensuring that any information you provide through the Website is correct, current and complete, and for your own use of the Website, including your computer, internet and data security.

6. Prohibited Activities

You agree to use the Website only for lawful purposes. In particular, you agree not to:

  • Use the Website in any way that breaches applicable law or regulation
  • Expose minors to inappropriate content or seek personally identifiable information from them
  • Send or knowingly receive spam, chain letters, or unsolicited advertising material
  • Impersonate the Company, our staff, or any other person or entity
  • Interfere with, damage or overburden the Website, or attempt to gain unauthorised access to it, its server, or any connected system
  • Use bots, scrapers or other automated means to access or copy content from the Website without our permission
  • Introduce viruses, malware or other harmful code, or attempt a denial-of-service attack
7. Intellectual Property Rights

The Website and its entire content, including text, images, design and functionality, is owned by us, our licensors, or other content providers, and is protected by copyright, trademark and other intellectual property laws in the UK and internationally.

You may view, print or download a reasonable number of pages for your own personal, non-commercial use. You must not modify, reproduce, republish, distribute or create derivative works from any part of the Website without our prior written consent, and you must not remove any copyright, trademark or other proprietary notices.

8. Our Rights

We may take appropriate action, including legal action or cooperating with law enforcement, in response to any illegal or unauthorised use of the Website. We may also suspend or terminate your access to the Website at any time, for any reason, including a breach of these Terms.

9. Third-Party Links and Content

The Website may link to third-party sites or content for your convenience. We don’t control, endorse, or accept responsibility for third-party sites, and if you choose to visit them, you do so at your own risk and subject to their own terms.

10. Disclaimers and Limitation of Liability

The Website and its content are provided on an “as is” and “as available” basis, without warranties of any kind, to the fullest extent permitted by law. We don’t guarantee that the Website will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by law, we won’t be liable to you for any indirect, incidental, special or consequential loss arising from your use of the Website, including loss of business, revenue, or data. Nothing in these Terms limits any liability that cannot lawfully be excluded, such as liability for death or personal injury caused by our negligence, or for fraud.

11. Indemnification

You agree to indemnify us against any claims, losses or costs (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Website.

12. Privacy

Any personal information you provide through the Website is handled in accordance with our Privacy Policy.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or your use of the Website will be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Severability

If any provision of these Terms is found to be unenforceable, the rest of the Terms will remain in full effect, and the unenforceable provision will be replaced with one that most closely achieves its original intent.

15. Entire Agreement

These Terms, together with our Privacy Policy, make up the entire agreement between you and us in relation to your use of the Website, and supersede any prior agreements on that subject. This doesn’t affect the separate client service agreement referred to in section 2, where one applies.

16. Waiver

If we don’t enforce a provision of these Terms on one occasion, that doesn’t mean we waive our right to enforce it later.

17. Notices

We may contact you by email, or by posting a notice on the Website. It’s your responsibility to keep any email address you’ve given us up to date.
